Topics will include the recently released FAQ on extracted performance issued by SEC staff. The FAQ indicates performance of a single or group of investments in a private fund is considered “extracted performance” under the new Marketing Rule. Accordingly gross performance for a single or group of investments cannot be presented without also showing net performance for the single investment or group of investments.
Panelists will also discuss whether attribution is considered “performance” under the new Marketing Rule.
